Your goods will be delivered to the delivery address provided at the time of placing the order, subject to payment of the relevant delivery charge.

If you’ve asked us to deliver to a location that we’re unable to deliver to, we will notify you as soon as possible on receipt of your order.

Deliveries are usually dispatched on the same or the next working day; in all but exceptional circumstances deliveries will be dispatched within 3 working days (Monday – Friday, excluding bank or public holidays in Scotland, England and Wales).

In the very unlikely event that we can’t fulfil your order within 28 days you have the option to cancel the order.

All prices in the Delivery table are estimates based on the US Dollar exchange rate and are subject to change - for final prices please proceed to checkout.

DELIVERY TO SOUTH KOREA
Customers with delivery addresses within South Korea have two options:

Standard deliveries of goods will be sent Airmail via Royal Mail. A signature is not required upon receipt. The expected number of business days for delivery is between 5 to 15. This is not a trackable service and transit time would normally be 5-15 business days, but can on some occasions take longer.

Express Tracked delivery within South Korea , for receipt of which a signature is required. The expected number of business days for delivery is between 1 to 6.


UK DELIVERY ADDRESS:
Customers with delivery addresses within United Kingdom have 2 options for delivery:

Standard deliveries of goods will be sent via Royal Mail to addresses within the UK. The expected number of business days for delivery is between 2 to 3. These items will not need to be signed for upon delivery. This is not a trackable service and transit time would normally be 2-3 business days, but can on some occasions take longer.

Express Tracked delivery, where upon delivery of the goods a signature is required. The expected number of business days for delivery is between 1 to 2.


NON UK DELIVERY ADDRESS:

DELIVERY TO THE EU (ex-UK)

Customers with delivery addresses outwith the EU have 2 options for delivery:

Standard deliveries of goods will be sent Airmail via Royal Mail. The expected number of business days for delivery is between 5 to 15. This is not a trackable service and transit time would normally be 5-15 business days, but can on some occasions take longer.

Express Tracked delivery outwith the EU, for receipt of which a signature is required. The expected number of business days for delivery is between 1 to 6.

Express Tracked delivery can be tracked up to the point of delivery. You can check the progress of your item by using Track&Trace. Upon despatch, you will receive an email notification with an estimated delivery date. A signature will be taken at your delivery address, ensuring that the goods are not left unattended or posted through a letterbox.

Please note that we cannot routinely provide a copy of this signature. If no one is available to sign for the item it will be retained by the postal administration for a subsequent delivery attempt or collection by the addressee. In the case of loss of an item we will request proof of posting from the respective postal administration but this cannot always be provided.

All customers outwith the UK can also request a Courier Quotation. In this instance we will contact you with the price of the delivery. Goods will be delivered via DHL or TNT, and a signature will be required upon arrival at the delivery address.

If you would like to provide additional, specific delivery instructions, we will not be liable for any loss or damage consequent to these instructions. If there is no one at the address given who can accept delivery of the goods, the postman or courier should notify you of an alternative delivery date, an alternative place to collect the goods, or details of how to arrange an alternative delivery date. Every effort will be made to deliver the goods as soon as possible after your order has been accepted by us, and in any event within 30 days of your order.


Customs & Import Duties
Please be advised that orders outside the UK and EU may be subject to import duties and local taxes that are levied when the delivery reaches the specified destination.

Please note that Dalvey have no control over these charges and cannot predict their amount. You will be responsible for payment of any such import duties and taxes. Please contact your local customs office for further information before placing your order.

Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for a breach of any such laws.


Personalised Orders
When an order includes an item personalised with engraving, we aim to dispatch within three working days. However, as all products are engraved by our in-house team, we cannot always guarantee that this will be the case: at times of high demand we may take a little longer. Please refer to sections 4.1 and 5 of our terms and conditions for further information.

If we are making a refund, we will usually do so as soon as possible, and in any event within 14 days of the day upon which we received the returned goods.

Unfortunately we cannot accept returns if the goods ordered have been personalised. This is only relevant to the specific goods that have been personalised, and not to the contents of an entire order.

Due to safety and hygiene reasons, we cannot process refunds of goods where security seals have been broken or opened (e.g. fragrance), unless the goods are defective.

This page states the Terms and Conditions (the "terms") under which you may use the website located at www.dalvey.com (the "website") and which govern our supply of goods to you. Grants of Dalvey Limited, registered SC99662, referred to hereinafter as "we", "us" or "our" in these Terms, may alter these Terms at any time by updating this posting. You should visit this page often to review the Terms and Conditions because they are binding on you. Continued use of the website constitutes your agreement to all such revised terms. If you do not accept the Terms and Conditions stated here, you will not be able to submit your order. The terms "you", "your", "yourself" and "yours", when used in these Terms, includes any user of the website, whether such user is an end user or a business. All prices quoted are in either Great British Pounds (GBP) Sterling (£), Euros (€) or United States (USD) Dollars ($).


1. Formation of the Contract 

On placing an order for goods, no contract will exist between you and us for the sale of any goods until you have received confirmation that your order has been dispatched. Once you receive confirmation that your order has been dispatched, there will be a binding legal contract in place between the parties (the "contract"). Any goods on the same order which are not confirmed as having been dispatched do not form part of that contract. In using this website and by placing an order, you confirm that you are legally capable of entering into a binding contract and that you are at least 18 years old.

2. Description and price of the goods

The description and price of the goods you order will be as shown on this website at the time you submit your order. Up until you click on “SUBMIT” on the final page of the ordering process you can correct any errors to your order. All sizes and measurements are approximate but we try to ensure that they are as accurate as possible. We may change product specifications slightly, and if this is the case we will offer you a reasonable substitute of the same or better quality at the same price. On the rare occasion that there is an error, we will advise you about it within a reasonable amount of time. We have created this Web Site to promote, sell and distribute our products. Our products are displayed in images on this Web Site to best communicate their physical form, function, colour and purpose. Many of our products are made with natural materials (e.g. leathers, precious stones, silk). These have been photographed to create the truest representation to you. We do not take responsibility for any mis-communication through no fault of our own. We can not guarantee that your monitor or viewing device will be calibrated to display the truest representation of our products. We can therefore not accept refunds due to changes in natural products (e.g. stones in cufflinks or grain in leather) or miss-representation of a colour (e.g. the colour of a tie). This does not effect your right of cancellation. Goods are subject to availability. If on receipt of your order the goods are out of stock, we will inform you within a reasonable amount of time and you are free to cancel your order. If you wish to cancel your order we will refund or credit you for any sum that has been paid by you or debited from your credit card or other account for those goods. From time to time there may be restrictions in place in relation to the number and type of goods that can be purchased and the maximum amount which may be spent on any one order. Any such restrictions will be shown on this website. Every effort is made to ensure that prices shown on this website are accurate at the time you place your order. If an error is found, we will inform you within a reasonable amount of time and offer you the option of reconfirming your order at the correct price or cancelling your order with a full refund or credit. Delivery costs are not included in the price of goods shown on this website. Details of delivery charges are given at the checkout stage, and in Section 4 below. Goods and promotions offered on this website may not necessarily be available in store and vice versa. 


3. Payment  

Payment for goods and delivery charges can be made by any method shown on the website when placing your order. Credit and debit cards will be authorised against the transaction when you submit your order.


4. Delivery

4.1 The goods you order will be delivered to the address you give when you place your order, subject to payment of the relevant delivery charge. If we do not deliver to a particular destination you will be so notified by us as soon as possible on receipt of your order. We aim to dispatch all deliveries within 3 working days (Monday - Friday (but excluding bank or public holidays in Scotland, England and Wales)) or as soon as possible thereafter subject to the goods being in stock. If, in the unlikely event, that we cannot fulfil your order within 28 days you have the option to cancel your order. Delivery timeframes, in business days, are shown for Standard and Express delivery. These are the expected number of business days for geographical zones, but are not guaranteed. 


4.2 UK DELIVERY ADDRESS: All standard deliveries of goods will be sent via Royal Mail to addresses within the UK. These items will not need to be signed for upon delivery.  This is not a trackable service and transit time would normally be 1-2 business days, but can on some occasions take longer.
Orders over £75 qualify for free standard delivery.

All customers within the UK have the opportunity to choose "Express Tracked" delivery where upon delivery of the goods a signature is required.
Orders over £150 qualify for free express tracked delivery.


4.3 NON UK DELIVERY ADDRESS:

4.3.1 DELIVERY TO THE EU (ex-UK)

Customers with delivery addresses within the EU have 2 options for delivery:

a) Standard deliveries of goods will be sent Airmail via Royal Mail. A signature is not required upon receipt. This is a trackable service and transit time would normally be 6-7 business days, but can on some occasions take longer.
Orders over £100 qualify for free standard delivery within the EU. 


b) Express Tracked delivery, for receipt of which a signature is required.
Orders over £200 qualify for free express tracked delivery within the EU.

4.3.2 DELIVERY OUTWITH THE EU

(USA, Canada and Rest of World)

Customers with delivery addresses outwith the EU have 2 options for delivery:

a) Standard deliveries of goods will be sent Airmail via Royal Mail. A signature is not required upon receipt. This is not a trackable service and transit time would normally be 6-11 business days, but can on some occasions take longer.

b) Express Tracked delivery outwith the EU, for receipt of which a signature is required.

4.3.3 Express Tracked delivery can be tracked up to the point of delivery in the destination country. You can check the progress of your item by using Track & Trace. 4.6 Personalised Orders

When an order includes a personalised item (e.g. engraving or monogramming options have been selected) it is still our aim to dispatch the order within 3 working days. Due, however, to the nature of the processes involved, seasonality and other factors we can not always guarantee that this will be the case. Please refer to sections 4.1 and 5 of the terms and conditions for further information.

5. Your right of cancellation

You have the right to cancel the contract at any time up to the end of 14 days after you receive your goods. You lose your rights of cancellation if goods ordered have been personalised. This is only relevant to specific personalised goods and not an entire order. To exercise your right of cancellation, you must give written notice to us by hand, post, fax or email, at the address, fax number or email address shown in the "contact us" pages of this website, giving details of the goods ordered and (where appropriate) their delivery. You may also use the cancellation form, but it is not obligatory. If you exercise your right of cancellation after the goods have been delivered, you will be responsible for returning the goods to us at your own cost (unless we delivered the goods in error or if the goods are damaged or defective when delivered). The goods must be returned to the address shown in the "contact us" pages of this website within 14 days of your receipt of those goods. You must take all reasonable care to ensure that the goods are not damaged in the meantime or in transit. Once you have notified us that you are cancelling the contract, and provided that the goods are received by us in an acceptable condition, we will refund or credit you within 14 days for any sum that has been paid by you or debited from your credit card or other account for those items.


6. Refunds

If you wish to obtain a refund, the goods must be returned to the address given in the "contact us" pages of this website within 14 days of your receipt of those goods, and in the same condition in which they were sent to you. You will be liable for paying the postage charge for returning non-faulty items. We will usually refund any money received from you using the same method originally used to pay for your purchase. If the goods were paid for using a card which has since been cancelled or expired, a cheque will be sent to your billing address. Only the cost of the standard delivery option is refundable unless we have sent you an incorrect item. If we are making a refund, we will usually do so as soon as possible and, in any case, within 14 days of the day on which we received the returned goods in question from you. If you wish to obtain a refund because of a defect in the goods, you will be refunded in full provided we are satisfied that the defect is genuine and that we cannot replace the goods within a reasonable period of time. Due to safety and hygiene reasons, we cannot process refunds of goods where security seals put in place by us have been broken or opened (e.g. Fragrance) unless the goods are defective.


7. Risk and Title

You will become the owner of your ordered goods and responsible for risk of loss of or damage to them from the time of delivery.


8. Warranty

If you receive any goods from us that are damaged, defective or incorrect you should notify us immediately in writing at the address, fax number or email address shown in the "contact us" pages of this website. If you return the damaged, defective or incorrect item to us within a reasonable time, we will provide you with a replacement, free of charge. This does not affect your statutory rights. This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use other than recommended by us, or failure to follow our instructions.

13.2 We shall not be liable to you in contract, tort (including without limitation negligence) and/or breach of statutory duty for any loss or damage which you may suffer by reason of any act, omission, neglect or default (including negligence) in the performance of this contract by us, or our agents, in a sum which is greater that the total price of the contract.

13.3 Nothing in these terms shall operate so as to:
• exclude either party's non-excludable liability in respect of death or personal injury caused by its negligence or the negligence of its servants or agents; or
• affect your statutory rights where goods are sold to you and you are dealing as a consumer within the meaning of the Unfair Contract Terms Act; or
• exclude the application of Section 12 of the Sale of Goods Act 1979; or
• exclude liability for fraudulent misrepresentation.

13.4 We will not be held responsible for any delay or failure to comply with the obligations under these terms if the delay or failure arises from any cause which is beyond our reasonable control.

For the avoidance of doubt, nothing in these terms shall confer on any third party any benefit or right to enforce any provision of these terms. The rights and remedies of each party in respect of these terms shall not be diminished, waived or extinguished by the granting of any indulgence, forbearance or extension of time by one party to the other nor by any failure of or delay by a party in ascertaining or exercising any such rights or remedies. The provisions of these terms are severable and distinct from one another, and, if at any time any of the provisions is or becomes invalid, illegal or unenforceable, the validity, legality or enforceability of the other provisions shall not in any way be affected or impaired.

19.1 The production of electrical and electronic equipment is one of the fastest growing domains of manufacturing in the western world, and with broad consumer take-up of products in this area, there is also a mounting issue of waste. In June 2000, the European Commission put forward proposals to address this issue, and in December 2002 these were passed as the EU Waste Electronic and Electrical Equipment (WEEE) Directive.

19.2 For the UK, the WEEE Regulations were laid before Parliament on December 12, 2006. The main requirements and obligations on producers and distributors of Electronic and Electrical Equipment (EEE) came into effect from July 1, 2007. All manufacturers (or anyone else selling a product on the market in the EU) are liable to pay for take-back, treatment and recycling of end-of-life equipment. Improve re-use/recycling of WEEE. DHL EXPRESS NETWORK TERMS AND CONDITIONS OF CARRIAGE AND CUSTOMS OPERATIONS (“T&C”)

 

These T&C are applied to services provided by Express Carrier DHL Express in respect of delivery of Express Shipments for personal use.

 

1. Terms used herein:

Express Carrier: DHL Express is represented within the Russian Federation by two entities, DHL International AO and DHL Express OOO.  DHL Express as well as third parties work together to deliver Express Shipments internationally and perform customs operations in respect of Express Shipments.

Customs Broker means DHL Express OOO performing customs operations in the name and on behalf of the customs applicant and other interested parties in accordance with the customs laws of the Customs Union.

Express Shipment means goods shipped in express mode by any means of transportation using electronic shipment organisation and tracking system on www.dhl.ru website to deliver those goods to the Consignee pursuant to an individual waybill within the shortest possible and/or fixed period of time.

Shipper means a legal entity, normally an online store, that handed Express Shipments over to the Express Carrier for delivery.

Consignee means an individual consignee of Express Shipment specified in the DHL Express waybill.

 

2. T&C Subject Matter

2.1. These T&C are a public offer and form a consensual type Delivery and Customs Operations Agreement in respect of Express Shipments by and between the Shipper/Consignee, the Express Carrier and the Customs Broker (“Agreement”).

2.2. Consignee of Express Shipments accepts the provisions of this Agreement for themselves and for other directly or indirectly interested parties, including the Shipper, by pressing a button, ticking a box or putting any other sign in the box “I accept terms and conditions of the Public Offer,” as well as/or by any other means of actual confirmation of their consent when ordering goods at the Shipper’s website.

2.3. Under the applicable legislation in Russian Federation Express Carrier and Customs Broker shall have the right to demand from Consignee documents and information necessary for international delivery of Express Shipments and customs operations in respect of Express Shipment, including those containing information comprising commercial, bank and other secrets protected by law, or other confidential information, and obtain such documents and information within the time limits ensuring observance of the requirements specified in the applicable legislation.

Express Carrier and Customs Broker hereby acknowledge and confirm that the obtained information comprising state, commercial, bank and other secrets protected by the law or other confidential information must not be disclosed or used by Express Carrier and Customs Broker and their employees for their own purposes, handed over to other persons, except for the cases envisaged in the applicable legislation in Russian Federation other cases when disclose of the information is required for international delivery of Express Shipments and customs operations in respect of Express Shipment.

 

3. DHL Express Network Terms and Conditions of Carriage.

3.1. The Shipper and the Consignee acknowledge that normal DHL Express Delivery Terms and Conditions apply to carriage of goods via DHL Express network; the key provisions thereof that are essential for the Consignee are listed below:

Deliveries and Undeliverables

Shipments cannot be delivered to PO Boxes or postal codes. Shipments are delivered to the Receiver’s address given by Shipper but not necessarily to the named Receiver personally. Shipments to addresses with a central receiving area will be delivered to that area.

DHL may notify Receiver of an upcoming delivery or a missed delivery. Receiver may be offered alternative delivery options such as delivery on another day, no signature required, redirection or collection at a DHL Service Point. Shipper may exclude certain delivery options on request.

If the Shipment is deemed to be unacceptable as described in Section 2, or it has been undervalued for customs purposes, or Receiver cannot be reasonably identified or located, or Receiver refuses delivery or to pay Customs Duties or other Shipment charges, DHL shall use reasonable efforts to return the Shipment to Shipper at Shipper’s cost, failing which the Shipment may be released, disposed of or sold without incurring any liability whatsoever to Shipper or anyone else, with the proceeds applied against Customs Duties, Shipment charges and related administrative costs with the balance of the proceeds of a sale to be returned to Shipper. DHL shall have the right to destroy any Shipment which any law prevents DHL from returning to Shipper as well as any Shipment of Dangerous Goods.

Inspection

DHL has the right to open and inspect a Shipment without notice for safety, security, customs or other regulatory reasons.

DHL’s Liability

DHL’s liability in respect of any one Shipment transported by air (including ancillary road transport or stops en route) is limited by the Montreal Convention or the Warsaw Convention, as applicable, or in absence of such Convention, to the lower of (i) the current market or declared value, or (ii) 19 Special Drawing Rights per kilogram (approximately $US 26.00 per kilogram). Such limits shall also apply to all other forms of transportation, except where Shipments are carried only by road, when the limits below apply.

For cross border Shipments transported by road, DHL’s liability is or shall be deemed to be limited by the Convention for the International Carriage of Goods by Road (CMR) to the lower of (i) current market value or declared value, or (ii) 8.33 Special Drawing Rights per kilogram (approximately $US 14.00 per kilogram). Such limits will also apply to national road transportation in the absence of any mandatory or lower liability limits in the applicable national transport law.

If Shipper regards these limits as insufficient it must make a special declaration of value and request insurance as described in Section 8 or make its own insurance arrangements.

DHL’s liability is strictly limited to direct loss and damage to a Shipment only and to the per kilogram limits in this Section 6. All other types of loss or damage are excluded (including but not limited to lost profits, income, interest, future business), whether such loss or damage is special or indirect, and even if the risk of such loss or damage was brought to DHL’s attention.

DHL will make every reasonable effort to deliver the Shipment according to DHL’s regular delivery schedules, but these schedules are not binding and do not form part of the contract. DHL is not liable for any damages or loss caused by delay, but for certain Shipments, Shipper may be able to claim limited delay compensation under the Money Back Guarantee terms and conditions, which are available on the DHL website at www.dhl.com or from Customer service.

Claims

All claims must be submitted in writing to DHL within thirty (30) days from the date that DHL accepted the Shipment, failing which DHL shall have no liability whatsoever. Claims are limited to one claim per Shipment, settlement of which will be full and final settlement for all loss or damage in connection therewith.

Circumstances Beyond DHL’s Control

DHL is not liable for any loss or damage arising out of circumstances beyond DHL’s control. These include but are not limited to electrical or magnetic damage to, or erasure of, electronic or photographic images, data or recordings; any defect or characteristic related to the nature of the Shipment, even if known to DHL; any act or omission by a person not employed or contracted by DHL - e.g. Shipper, Receiver, third party, customs or other government official; “Force Majeure” - e.g. earthquake, cyclone, storm, flood, fog, war, plane crash, embargo, riot, civil commotion, or industrial action.

Routing

Shipper agrees to all routing and diversion, including the possibility that the Shipment may be carried via intermediate stopping places.

4. Customs Operations Terms & Conditions

4.1. Customs Broker:

4.1.1 may performs customs declaration of Express Shipments;

4.1.2. shall inform the Consignee of the date of the goods arrival to the temporary storage facility (TSF) by fax or email;

4.1.3. shall perform other actions stipulated in the customs laws of the Customs Union and the Russian Federation as necessary to perform the customs operations as a person authorized by the Consignee to act in respect of the declared Express Shipments.

4.2. The Consignee shall provide comprehensive and accurate details and documents to perform declaration of the Express Shipments as stipulated in the customs laws of the Customs Union and the Russian Federation and provide additional documents at the Customs Broker’s request.

All the documents required to declare the goods should be provided within ten (10) calendar days from the moment the goods arrive to the TSF.

4.3.The Consignee would take of formalities related to the frequency of receiving shipments at his own risk and cost

4.4.The Shipper and the Consignee guarantee that they have legal authority or other legal grounds for the Customs Broker to perform legally relevant actions on their behalf and shall be fully liable for providing comprehensive and accurate information in respect of the Express Shipments.

 

5. Liability of the Parties

5.1. The Consignee shall be liable for penal sanctions imposed on the Customs Broker as a result of the latter’s breach of customs regulations due to the Consignee’s failure to provide comprehensive and/or accurate information and documents, including inconsistencies in transported goods to their accompanying documents in terms of their name, quantity, other characteristics affecting due declaration, as well as the Consignee being late in providing those documents and information; and in that case the Consignee shall reimburse the Customs Broker all the amounts of such sanctions against a separate invoice.

5.2. The Customs Broker shall not be liable for lost profits or other consequential and contingent damages of the Consignee even if such damages are foreseeable or have been made known to the Customs Broker or the Customs Broker could or should have known about them.

5.3. The Parties shall be released from liability for full or partial non-performance of their respective obligations hereunder if it became a result of Force Majeure circumstances and those circumstances directly affected performance of this Agreement.

 

6. Service Fees and Payment for Customs Operations:

6.1. Service fees are determined based on the Customs Broker’s rates as of the invoice date, including amounts of customs and other fees paid by the Customs Broker while providing services hereunder.

6.2. The Consignee must pay for the Customs Broker’s services.

6.3. The Customs Broker reserves the right to withhold any goods of the Consignee at the latter’s expense until the Customer Broker’s services provided to the Consignee hereunder are paid in full.

 

7. General Provisions

7.1. Should the T&C and/or Agreement text change, the Parties agree to apply the T&C effective as of the date of consent specified in Clause 2.2.
